Terms and conditions

 

Services

 

Kingfisher Guides provides you with unique experiences by offering guided fishing trips in Scotland. We run either half-day or full day fishing trips and all of our trips include; correct fishing permit, transport from a local pick up point (if required) and photography.
 

Fly fishing or Bait fishing is offered from either boat or bank for sea, game and coarse species of fish.

 

We provide fishing guide, rod, reel, terminal tackle, life jacket, sunglasses. Waders can be provided if the style of fishing requires at no extra cost.

The safety equipment in the form of life jackets and sunglasses are always provided and must be worn at all times.
 

No waterproof or warm clothing will be provided.

No drinks or food will be provided unless arranged separately before the scheduled day at extra cost.


Customers must agree to follow instructions given to them by Kingfisher Guides.

All clients are advised to have third party insurance against sporting accidents.

 

Prices
 

All prices are subject to change

 

Dependent on fishing style and location all prices will be agreed with client before any deposit is required.

 

The price (half day or full day fishing) will include everything you need to enjoy your day not limited but including (fishing guide, rod, reel, terminal tackle, correct permit, transport from a local pick up point if required and photography).

 

Extra services can be provided on request and will be subject to extra cost / charge, which will be detailed on your package price.

 

Package price agreed with client will include a full break down of trip and services to be provided by kingfisher guides.

 


Payment

A deposit of 30% is required to confirm the reservation. All Deposits paid are non refundable.


Payment must be made in full 28 days before date of trip.

Payment can be made by either Paypal or BACS transfer. We do not accept cash.

Paypal accepts all major credit cards and debit cards even if you don’t have a Paypal account.


Cancellation

Kingfisher Guides can cancel trips if weather conditions are extreme. If Kingfisher Guides cancels a trip, we will endeavour to provide you with an alternative date and time.

 

A full refund will be given if the alternative date is not suitable.


We will run our trips regardless of the type of weather (i.e. we will run our excursions even if there is wind, snow, hail or rain). However, if you do not wish to fish in such weather, an alternative date can be arranged but no refund will be given.
 

Any booking is subject to a 14 day cooling off period and can be cancelled with no charge and a full refund up to 14 days after booking is paid.

 

Any cancellation by customer with less than 14 days before trip will only be offered an alternative day. All cancellations must be made by email, and confirmed by kingfisher guides.


All permit prices or related cost to fishing trip will be charged to customer if trip is cancelled.


All rearrangements of bookings must be suitable for both parties and agreed by email.

Photography

Any photography or video taken during guided fishing trips remain the property of Kingfisher Guides and Jonathan James.

Photography and video may be used in all media platforms, social media, facebook, instagram, twitter, if you do not agree with this advise Kingfisher Guides on booking.

Photos will be sent to all customers via email as a reminder of their day.

All persons under the age of 16 must have permission from parent or authorized person to be included in social media.


Bookings

After a suitable date is agreed confirmation will be made by email.

All bookings are accepted on the agreement that the customer has read and agreed all the terms and conditions which will be supplied at time of booking.

 

Limitation of Liability

 

Kingfisher Guides accepts no liability (whether or not losses or damage were foreseen, direct, foreseeable, known or otherwise) for loss, damage, delay, inconvenience, (including but not limited to, loss of revenue; loss of actual or anticipated profits (including without limitation loss of profits on contracts); loss of the use of money; loss of business; loss of opportunity; loss of goodwill; loss of reputation; loss of, damage to or corruption of data; or any indirect, special or consequential loss or damage) however caused, unless due to our negligence in which case our liability is limited to a maximum of the participant's fee for the class undertaken.


Your personal items are your responsibility. We will not accept responsibility for the loss or damage of any personal possessions.  Classes can result in clothing and personal items being damaged and we advise that you should wear old clothes to all classes. We take no responsibility for damages incurred in classes.

Any outdoor trips are completely at the participants own risk.

Nothing in this legal notice shall exclude or limit our liability for:

 

·         Death or personal injury caused by negligence (as such term is defined by the Unfair Contract Terms Act 1977); or
 

·         Fraud; or misrepresentation as to a fundamental matter;
 

·         or any liability which cannot be excluded or limited under applicable law.

 

Governing Law

 

These terms and conditions shall be governed by and construed in accordance with Scots Law and are subject to the exclusive jurisdiction of the Scottish courts.
